Our services include:

  • Online and face-to-face tutoring for Years 2–12
  • Access to GenieBuddy, our AI learning assistant
  • Group or 1-on-1 sessions tailored to individual learning needs
  • Australian Curriculum–aligned resources

By using our services, you agree to these Terms of Service (“Terms”).

2. Acceptance of Terms

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are under 18, a parent or legal guardian must accept these Terms on your behalf.

3. Privacy Policy

Please refer to our Privacy Policy for information on how we collect, use, and store your personal data. Your use of our services is subject to our Privacy Policy.

4. Registration and Accounts

  • You must provide accurate and complete information when registering.
  • If registering on behalf of a child, you confirm that you are their parent or legal guardian.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Please notify us of any unauthorized use of your account.

5. Use of Services

You agree to:

  • Use our services for lawful, educational purposes only.
  • Not engage in any activity that may harm the platform or other users.
  • Refrain from uploading any content that is malicious, misleading, or infringes on any third-party rights.

6. Pricing, Payments & Cancellations

6.1 Pricing

Our pricing varies based on:

  • School level (Primary, Secondary, or Sr. Secondary)
  • Session type (1-on-1 or group)
  • Specialised programs (e.g., exam preparation)

Pricing details are listed on the Website or during booking can be discussed for the custom quote.

6.2 Payments

  • All payments must be made in advance via credit card or other approved methods.
  • Prepaid sessions must be used within the validity period specified at purchase.

6.3 Cancellations

  • If you cannot attend a tutoring session and wish to reschedule, you must provide GeniusHub Learning with at least 24 hours’ notice prior to the scheduled session.
  • If you provide less than 24 hours’ notice for a reschedule, 60% of the session fee will be charged.
  • We do not encourage cancellations of sessions as they affect tutor availability and scheduling efficiency.
  • If, for any reason, you wish to cancel a session and are unable to reschedule, you must provide at least 48 hours’ notice prior to the scheduled session. If less than 48 hours’ notice is given for cancellation, 60% of the session fee will be charged.
  • A session cannot be rescheduled for more than two times.
  • Rescheduled sessions cannot be cancelled; they must be attended or rescheduled again within the allowed limit. If a rescheduled session cannot be accommodated due to tutor or student availability, 60% of the total session fee will be charged.
  • For full service cancellation (ending ongoing tutoring services), a minimum of 7 days’ notice is required.

7. Refund Policy

  • No refunds are available for completed sessions unless explicitly agreed upon.
  • You acknowledge that once the session fee is charged by us, the session fee is nonrefundable by GeniusHub Learning and we have no liability to you in respect of the session fee.

8. Intellectual Property

  • All content and tools provided by GeniusHub Learning are protected by copyright and intellectual property laws.
  • You may not reuse, modify, or distribute any content without our written permission.
  • You retain ownership of content you upload but grant us a limited license to use it for service delivery.

9. Limitation of Liability

To the extent permitted by law:

  • We are not responsible for indirect, incidental, or consequential losses.
  • We are not liable for disruptions beyond our control (e.g., internet issues, platform downtime).
  • You use our services at your own risk.

10. Australian Consumer Law

Nothing in these Terms excludes your statutory rights under the Australian Consumer Law. Where permitted, our liability is limited to:

  • Resupplying the services, or
  • Refunding the cost of the service.

11. Termination and Suspension

We reserve the right to suspend or terminate access to services if:

  • You breach these Terms;
  • You misuse the platform;
  • You fail to make timely payments.

You may terminate your account at any time by contacting us directly.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to the exclusive jurisdiction of the courts in Victoria for resolving any disputes.

15. Definitions

  • “Tutor” – an individual providing tutoring services via our platform.
  • “Student” or “User” – a registered learner using our services.
  • “Services” – any tutoring, resources, or tools provided by GeniusHub Learning.
  • “GenieBuddy” – our AI assistant that provides support between sessions.
